I have read the health guarantee COMPLETELY before I agree to put a deposit on a puppy by also agreeing to the terms and conditions within this contract.

Buyer has paid a deposit of $ 300.00 sent via Payment of GOOD DOG, the balance may be made by CASH only! If Buyer fails to complete the purchase of the Dog for any reason, or in the event that the dog is not available due to sickness, death, or any other circumstance owing to the fault of Seller, Buyer’s deposit will, at Buyer’s option, be either refunded, or transferred to a Dog in the next litter. If the seller has to drive to meet the buyer, the buyer agrees to pay $2.00 a mile for total mileage. Seller represents and warrants to Buyer that: Seller is the legal and true owner of the Dog, and that Seller has full right and authority to sell the Dog. The Dog is being sold free and clear of any lien, security interest, charge or other encumbrance. Seller does not assume responsibility for any other veterinary bills or other expenses incurred by the purchaser on behalf of the dog after the Dog has left possession of the Seller. Seller guarantees that the Dog is a purebred dog, offspring of the purebred Sire and purebred Dam. The Dog is in good health and free of communicable diseases at the time of this sale. Buyer has 2 days from purchase date to have the Dog examined by a licensed veterinarian, at Buyer’s sole cost. If the Dog fails the examination, Buyer may return the Dog, with 2 written statements and bills from two different licensed veterinarians. Failure by Buyer to have the Dog examined within the 2-day period will nullify this warranty! If Buyer chooses to keep the dog, no replacement will be given, and all medical costs and treatment are the sole responsibility of the Buyer. This health guarantee will be null and void. It is up to us, the breeders, to decide when the Dog will be ready to go to his new home. Usually at the age of 8 weeks, depending on the current health, weight of the puppy and how well it is weaned from the mother, etc. I will not under any circumstances let the puppy leave before the seller and breeder feel it is ready! The Dog will have been vet checked, its first set of shots, dewormed and deemed in good health by a licensed veterinarian at the time of the sale. The Dog will be up to date at the time of pickup. It is very important to continue the vaccinations and worming to have a healthy and happy Dog. *Documentation must be sent to the breeder within 5 days in order for the Health Guarantee to be honored. This Guarantee does NOT cover: Intervertebral Disc Disease (IVDD), Epilepsy, Dynamic Retinal Decay (PRA), Gastric Dilation-Volvulus (GDV), Cushing’s disease (hyperadrenocorticism), Dog Diabetes Mellitus (DM), Deafness, Dental issues and gum disease, infections, Canine obesity and weight gain, Allergies (including fleas food and pollen), Eye problems, Intervertebral Disc Disease (a condition that affects the dog’s back), Hip dysplasia, hypothyroidism, canine cancer, skin problems, seizures, and heart problems, heart murmurs, cherry eye, entropion, colds, undescended testicles, stenotic nares, elongated soft palate, umbilical hernia, dermatitis, external or internal parasites, mange, puppy demodex, OFA evaluations, dew claw regrowth or under / overbite. The Seller will NOT replace a puppy due to heat stroke, abuse/neglect, or improper socialization. The Buyer agrees to maintain preventative care of the puppy in regard to hip dysplasia, such as proper nutrition, proper exercise, and preventing stress injuries (i.e., not allowing the puppy to jump from heights taller than itself at the shoulder, no forced exercise such as running, no climbing of stairs, or anything else that would be strenuous to the hip joints.) The buyer further understands that this puppy is not being sold with a guarantee against Canine Hip Dysplasia, as that condition can be caused by environmental situations that are not within the control of the seller once buyer assumes possession. Buyer agrees that they have thoroughly researched the breed and understand the many health issues they can possess. Buyer is responsible for all medical costs of their Dog. This guarantee covers only the original Buyer and is not transferable to anyone other than the sole Buyer. The breeder assumes no responsibility for training difficulties, behavior problems, crate training or potty training, personal damages, property damages, etc. The breeder does not guarantee size; puppy/dog is being sold as a Miniature but there are too many variables and genetics to count for. We can give the buyer an educated guess but can give nothing more than that.
** (Not breeding -____________________Limited AKC Registration, never to be used for breeding purposes, and to be spayed or neutered by 1 year old. It does allow any and all placements into hunt and field tests, tracking, agility, companion dog etc. With this type of registration proof of spay or neuter does need to be provided from a certified veterinarian before the Dog is 1 year old and sent to breeder, if you want your dog Registered with the American Kennel Club. Once proof is sent I the Breeder will pay for the proper paperwork. Once that is filled out it will be sent to you within 2 weeks. The Dog was bred as a companion animal ONLY. Buyer will have the Dog spayed or neutered by the age of 12 months old. The Dog will reside with Buyer as companion pet to Buyer and Buyer’s family. Buyer will keep the Dog in an enclosed area of adequate size and will not allow the Dog to roam at will. Buyer will provide the Dog with nutritious food and necessary veterinary care, including deworming, heartworm prevention, flea and tick medication and regular vaccinations (including rabies). Buyer agrees to notify Seller if the Buyer no longer wants or is able to keep the puppy/dog at any time in the puppy/dog life. Buyer will give Seller 30 days notice so Seller has ample time to prepare for the puppy/dog to come back. Also Buyer is responsible for bringing the puppy/dog back to the seller. No money will be given at any point in time regardless of the length of time the buyer owned the puppy/dog. Buyer is not acting as an agent for any other person or business in the purchase of the Dog. Buyer will not sell, give, re-home the Puppy/Dog away until Breeder/Seller is notified and given full opportunity to take the dog back if at all possible, if other arrangements need to be made the Breeder still needs to be notified first. Buyer will not sell, give, or release the dog to a pet shop, retail store, dog dealer, animal testing facility, research facility, or an agent for any such business or facility, etc. If any action or failure to act on the part of Buyer shall result in any claim, suit, loss, damage, injury, death, or liability, Buyer agrees to hold Seller harmless and to pay all of Seller’s costs and expenses, including any and all legal fees, any amount paid in settlement and any award or judgment with respect thereto. Buyer releases Seller from any and all liability, costs or damages caused by the Dog after placement with Seller, including but not limited to damage to or destruction of property, and injury to any person. Any action or claim brought by Buyer against Seller for breach of this Agreement or for loss due to negligence must be brought within one (1) year of the date such claim or loss occurs to Franklin County, VA courts. This Agreement represents the entire agreement between the parties. Seller and Buyer have made no other agreements, promises, representations or warranties, express or implied, unless specifically stated in this Agreement.
